Purpose

On the Goodwill blog forachangingworld.com (hereinafter: “the Blog”), BNP Paribas has made available an online public space (hereinafter: “the Space”) for the purpose of dialogue and exchange of views between web users. The goal is to encourage discussions on BNP Paribas-led community initiatives, and more generally on the challenges posed by modern-day good citizenship.

This Space is governed by these Terms of Use. Anyone who accesses or uses this Space, whether on a regular or occasional basis, thereby accepts all the provisions of these Terms of Use.

BNP Paribas is free to amend these Terms of Use at any time.

You are therefore obliged to refer to the online version as of the date that you make a contribution to the Blog.

Access to the Space

Access to the Space requires an internet connection, for the correct functioning of which you are responsible.

Participation in the Space (writing contributions and comments) requires prior registration as an identifiable user (email address, pseudonym or family name). It is your responsibility to use a valid user name (email address).

You are solely responsible for protecting and for safeguarding the confidentiality of your user name, and for any actions that may be taken in your name as a consequence of the use thereof.

You agree to take all measures necessary for safeguarding the confidentiality of your User Account and to inform BNP Paribas immediately of any fraudulent use of the account by any non-authorised third party.

BNP Paribas may not be held responsible for any loss of data or for any other damage whatsoever resulting from a failure to respect these obligations.

Terms and conditions of participation

You are invited to suggest subjects for discussion related to the citizenship initiative launched by BNP Paribas, as well as to exchange views and to reply to contributions published.

For these purposes, you may formulate ideas, and comment on or agree with ideas posted by other web users.

You remain the owner of the message and, if relevant, the owner of any related intellectual property rights. You may be held responsible for your contributions made to this dialogue space. For this reason and in this regard, you must respect the laws and regulations in force.

You must not therefore send any messages that are aggressive, insulting, defamatory, paedophilic or racist in nature, which question a legal judgement or which defend war crimes, which call for an act of murder or incite suicide, or incite discrimination or hatred, or which reproduce, without permission, any work protected by intellectual property rights (for example, articles from the press, or the message of a third party).

In order to maintain a high standard of communication on the Blog, please ensure that you:

- respect the rules of courtesy required for the appropriate conduct of debate;
- avoid messages that are not properly argued;
- Only use the English language;
- do not write only in capital letters;
- avoid repeated punctuation marks;
- make only moderate use of short-text-message abbreviations;
- choose a heading that is related to the purpose of your message.

Equally, any reader of the Space shall respect the intellectual property rights of the authors/users. The reader must take care not to reproduce or distribute any contribution published on the site without the agreement of the author. Any reader may, however, reproduce the contents of any contribution to the Space for the sole purposes of private consultation. He may also reproduce and distribute short extracts from a message for purposes of information or research, provided that he quotes the name of the Space and that of the author of the message (real name or pseudonym).

At the same time, the author of any contribution authorizes BNP Paribas to make use of any part or the whole of the content of a message, in an anonymous form, for the purposes of corporate communication.

Moderation

BNP Paribas wishes to maintain a degree of courtesy in exchanges and to reject contributions that would otherwise run counter to the law or to regulations in force.

For this reason the contents of the Space are subject to preliminary moderation: all contributions will be read and checked by the Space’s moderator before publication. Messages will not therefore be posted immediately.

The moderator will ensure that your contribution is relevant to the subject of the goodwill initiative discussed in the Space, that it is not irrelevant, that it respects the law and regulations in force and that it allows constructive debate.

In order to maintain the standard of debate, the moderator reserves the right in particular to rewrite the message in good French, to refuse publication of unnecessary messages or of messages which amount to publicity or advertising, which are contrary to public order or good morals, which are violent or racist in nature, which defend war crimes, are offensive or vulgar, which are contrary to copyright or similar rights or contrary to the law applying to databases, which are contrary to rights to the use of images, to privacy, or which infringe any other legal or regulatory requirements in force.

In the event of any infringement of these terms and conditions, the moderator may, at any time, refuse you access to the Space, either on a provisional basis or permanently.

Protection of personal details

As part of the operation of the Space, BNP Paribas will request or collect certain personal data from you, whether nominative (relating to your person) or purely technical (IP address, cookies, etc.).

These data are used to increase use of and to develop the Space.

By using this Space, you thereby give your consent to the effect that all or any of the personal details freely offered by you may be published on the discussion Space, and that as a result they may be visible to other users and potentially to any web user.

BNP Paribas certifies that the collection of these personal data has been declared to the National Commission on Data Collection and Liberties (Commission Nationale Informatique et Libertés, or CNIL).

BNP Paribas undertakes not to communicate and not to divulge any of your personal data gathered by the Space, unless it is required to do so by a legal authority or legal stipulation.

The data will be kept for the strict requirements of the Space and will not be kept for any reason or time beyond those purposes.

Pursuant to the provisions of French Law 78-17 of 6 January 1978 pertaining to computers, files and freedoms, as amended by the Law dated 6 August 2004, you have the right to access, correct or delete any or all of the personal data relating to you which have been collected during the use of the Space.

Intellectual property

BNP Paribas is the owner of or the holder of the rights to all the elements that make up this Blog (forachangingworld.com), and in particular of all data, drawings, graphical elements, photographs and soundtracks included therein.

Any reproduction, representation, broadcast or rebroadcast, whether in whole or in part, of the contents of this Blog by any means whatsoever and without the express and prior permission of BNP Paribas is forbidden, and shall constitute an act of counterfeit punishable under articles L 335-2 and those following it of the Intellectual Property Code.

Nevertheless, since the Blog is a shared space, BNP Paribas is not opposed to the rebroadcast of videos published on the Space, with the proviso that such videos may not be re-edited or remixed before rebroadcast.

The trademarks of BNP Paribas and its partners as well as all logos appearing on the Blog are registered trademarks. Any reproduction whether in part or in whole of such logos, performed on elements of the Blog and without the express permission of BNP Paribas or its successors is therefore prohibited pursuant to article L 713-2 of the Intellectual Property Code.

As an exception, certain content elements (text, images) are the property of their respective authors.

BNP Paribas makes use of such content with the permission of the holders of the rights over the works concerned. Any reproduction, representation, broadcast or rebroadcast, whether in whole or in part, of such content taken from the Blog is expressly forbidden.

Limitation of responsibility

Any comment published on the Space is and shall remain the sole responsibility of the author and shall be binding on him alone. BNP Paribas shall not be held responsible for any contribution communicated via the Space by users. In this regard, BNP Paribas reminds you that you alone are responsible for the digital content published by you via the Space.

BNP Paribas reserves the right to hold you responsible under civil or criminal law particularly in cases of messages that are racist, abusive, defamatory or pornographic, and more generally in the event of any infringement of laws or regulations in force, whatever the medium used.

Under no circumstances may BNP Paribas be held responsible for the content of the Blog, in particular for the illegal character thereof under the regulations in force, or for errors or omissions in any content published on the Space, or for any loss or damage resulting from the use of any element of content posted or transmitted or otherwise communicated via the Space.
